Moving to Dubai from South Africa? How the physical presence and ordinarily resident tests work, and what to ask before you rely on non-resident status.
South Africa to Dubai · Tax Basics Moving to Dubai: Do You Stop Being a South African Tax Resident? Planning to work or retire in Dubai? Many South Africans assume that leaving means they stop being tax resident. It does not work that way. This Banke South Africa guide explains the two residency tests in plain terms and what to ask before you move. The Short Answer South African tax residency is decided by two tests: the ordinarily resident test, which looks at where your real home is and your intention, and the physical presence test, which counts days. Moving to Dubai does not automatically end your South African residency. Formally ceasing residence is a separate step, and you should take advice from a registered tax practitioner or SARS before you rely on any summary, including this one. The Physical Presence Test Published SARS guidance (Interpretation Note 4) describes three conditions, all of which must be met in a tax year: You were in South Africa for more than 91 days in the current tax year. You were in South Africa for more than 91 days in each of the five preceding tax years. You were in South Africa for more than 915 days in total across those five years. Fail any one and you do not satisfy this test. A South African tax year runs from 1 March to the end of February. Days are counted as whole days, including arrival and departure days. The Ordinarily Resident Test This test is subjective. It asks where you return to naturally, your usual or principal home. If you keep a home, family and ties in South Africa, you may stay ordinarily resident even while working abroad. Leaving the country does not by itself end it. Why This Matters for Dubai Property Your residency status affects how SARS treats your worldwide income, including rent from a Dubai property. The South Africa and UAE tax treaty may affect where income is taxed. See our guide to the South Africa-UAE tax treaty and Dubai property . Moving money offshore has its own rules. See our guide on moving money from South Africa to buy Dubai property and on financial emigration . Questions to Ask Before You Move Which of my ties to South Africa will remain, such as a home, family or business? How many days will I spend in South Africa each tax year? Do I need to notify SARS, and how do I do it? How will my South African assets and my Dubai property be taxed? Why Choose Banke South Africa? Banke helps South Africans plan a Dubai move or purchase and points to SARS and qualified advisers on tax. We do not give tax advice. To discuss your plans, contact the Banke South Africa team . Conclusion Residency turns on days and on ties, not only on a flight out. Count your days, understand your ties and get advice before you assume you are non-resident. Note: The day-count conditions come from published descriptions of SARS Interpretation Note 4. The SARS site could not be reached for a same-day check, so verify them against the current note.
